HigherData Terms

Last updated: October 14, 2026

These HigherData Terms form part of the HigherTools Terms of Service and apply to your use of HigherData. Capitalized terms not defined here have the meanings in the Terms of Service. "HigherData Data" means the company, contact and insight records, search results, enrichment values and other data we supply through HigherData, in any form, including copies and anything derived from them. HigherData Data does not include Customer Data.

1. Beta and access by request

1.1 HigherData is in beta. It is available only to workspaces we approve. Submitting a request does not oblige us to grant access, and we may approve, delay or decline any request for any reason.

1.2 Beta terms in section 5 of the Terms of Service apply. Features, data coverage, plans, prices and limits may change at any time during the beta, and the beta may end.

1.3 If you buy the HigherTools bundle, HigherCoach and HigherChat start right away, and HigherData starts once we approve your workspace. If we decline your HigherData request, or have not provisioned HigherData within 30 days of your bundle purchase, we will switch your subscription to yearly HigherCoach and HigherChat plans and refund the difference between what you paid for the bundle and the yearly price of those plans for the current term. This is your only remedy for HigherData not being provisioned.

2. Plans and fair use

2.1 Each plan includes unlimited search and enrichment within your organization, subject to fair use. Features, data fields, speed and connections differ by plan, as shown when you subscribe.

2.2 Fair use. "Unlimited" means you are not charged per search or per enrichment. It does not mean use without limit. Fair use is use that is consistent with the normal internal sales, marketing and operations needs of an organization of your size on your plan. We decide in our sole discretion whether use is excessive or abusive. Indicators include volumes far above typical customers on the same plan, systematic or automated extraction of large parts of the dataset, repeated bulk exports, use that suggests resale or redistribution, and use that degrades the service for others.

2.3 What we may do. To protect the service, we may at any time and without notice set or change rate limits, throttle or queue requests, cap exports, require you to move to a higher plan, suspend HigherData, or terminate your access. We do not publish fixed limits, and limits can differ between customers.

3. Your licence to HigherData Data

3.1 HigherOps owns HigherData Data and all rights in it. During your subscription we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use HigherData Data for your own internal business purposes of finding, contacting and managing relationships with business prospects and customers.

3.2 You must not, and must not let anyone else:

  1. sell, resell, license, rent, share, publish, distribute or disclose HigherData Data to any third party, including affiliates, clients or partners, except to your own service providers working only for you under confidentiality obligations;
  2. use HigherData Data to create, enhance, verify or train any database, data product, list-brokering service or AI model offered to anyone other than you;
  3. extract, download or export HigherData Data in bulk, or attempt to recreate any substantial part of the dataset, other than through the exports we provide for records you use in your normal work;
  4. combine HigherData Data with other data to identify, track or profile individuals outside a business context;
  5. use HigherData Data for any purpose listed in item 3 of the Acceptable Use Policy (eligibility decisions about people), or for any purpose that would make us a consumer reporting agency;
  6. remove suppression flags, opt-out markers or any notices we include.

3.3 After your subscription ends. You may keep HigherData Data that is in your CRM when your subscription ends, and use it under section 3 and the Acceptable Use Policy. You must stop using and delete all other HigherData Data, including lists, exports and copies outside your CRM, within 30 days, and confirm deletion if we ask. We keep the Customer Data you synced to HigherData for 30 days after your subscription ends, then delete it, except for copies in backups, which expire on their normal schedule.

4. Your compliance responsibilities

4.1 You are solely responsible for how you use HigherData Data, including every message you send and every call you make. As between you and us, you are the party that decides why and how personal information in HigherData Data is used.

4.2 Before contacting anyone, you will make sure you have the consent or other legal basis the law requires, and that every message identifies you, offers a working unsubscribe, and honours it promptly. This includes Canada's Anti-Spam Legislation, PIPEDA and provincial privacy laws, the US CAN-SPAM Act and Telephone Consumer Protection Act, the EU and UK GDPR and their e-privacy rules, and do-not-call registries.

4.3 You will honour opt-out, deletion and access requests that relate to HigherData Data in your systems, and forward to us promptly any request that relates to our dataset.

5. Enrichment, merges and CRM changes

5.1 When you connect a CRM, HigherData may write to it as you configure. Today HigherData writes to HubSpot only. Empty fields can be filled automatically; changes that overwrite existing values or merge records need your approval.

5.2 You are responsible for reviewing and approving changes, for your CRM settings and permissions, and for keeping your own backups. We are not responsible for changes you approve or configure, or for data lost or altered in your CRM as a result.

6. Email verification credits

6.1 Email verification uses prepaid verification credits, sold separately from plans. No plan includes verifications.

6.2 One credit is used each time we verify an address with a verification provider. Results we already hold may be returned without using a credit.

6.3 Verification credits have no cash value, are non-refundable and non-transferable, and do not expire while your account is open. Unused credits are forfeited when your account closes or is terminated for breach.

6.4 A verification result is an estimate at a point in time. It does not guarantee that a message will be delivered or that an address belongs to a particular person.

7. No warranty on data

HigherData Data describes people and companies, and that information changes constantly. WE DO NOT WARRANT THAT HIGHERDATA DATA OR ANY VERIFICATION RESULT IS ACCURATE, COMPLETE, CURRENT OR LAWFUL FOR YOUR INTENDED USE, OR THAT ANY PARTICULAR RECORD, FIELD OR VOLUME WILL BE AVAILABLE. Data coverage and record counts we describe in marketing are approximate and may change. Section 13 of the Terms of Service applies in full.

8. Indemnity

In addition to section 15 of the Terms of Service, you will defend, indemnify and hold harmless HigherOps from all claims, fines and costs arising out of your use of HigherData Data, including any message, call or decision you make with it and any breach of section 3 or 4.

9. Changes

We may change these HigherData Terms under section 16 of the Terms of Service.
