HigherChat Terms

Last updated: October 14, 2026

These HigherChat Terms form part of the HigherTools Terms of Service and apply to your use of HigherChat. "Your Site" means any website or app where you install HigherChat. "Visitors" means people who use HigherChat on Your Site.

1. What HigherChat does

HigherChat is an AI chat assistant you place on Your Site. It answers Visitors using knowledge you import and approve, can open conversations at moments you configure, collects contact details Visitors choose to give, and can book meetings and send leads to systems you connect, such as HubSpot.

2. Your content and answers

2.1 You are responsible for the knowledge, instructions, prompts, offers and other content you give HigherChat, and for reviewing what it learns from Your Site before you publish.

2.2 HigherChat's answers are Output under section 7 of the Terms of Service. They can be wrong or incomplete, and they speak for you, not for HigherOps. You are responsible for every answer HigherChat gives Visitors, including any statement about prices, terms, products, availability or commitments. Tell Visitors that answers may contain errors where that matters.

2.3 You will not configure HigherChat to give legal, medical, financial or other regulated advice, to make binding offers, or to collect payment card details, government identifiers, health information or other sensitive information.

3. Visitors: notices and consent

3.1 You are responsible for telling Visitors they are chatting with an AI assistant, for your own privacy policy covering HigherChat, and for any notice or consent the law requires on Your Site, including for the local storage HigherChat uses and for sending Visitors marketing.

3.2 HigherChat stores information in the Visitor's browser using local storage and session storage. It does not set cookies on Your Site. It records information HigherChat needs to work, including an anonymous visitor identifier, the conversation, contact details the Visitor types, pages and sections viewed, page addresses and referrers, and IP addresses, which are used for abuse prevention and deleted within 2 days. If you turn on optional features, HigherChat may also identify a Visitor from forms on Your Site or look up the Visitor's company from the IP address.

3.3 As between you and us, you decide why and how Visitor information is collected and used, and we process it on your behalf to provide HigherChat.

4. Leads and connected systems

When a Visitor shares contact details or books a meeting, HigherChat can send the lead and the conversation to systems you connect. You are responsible for your use of those leads, including anti-spam and privacy obligations when you follow up.

5. Retention

Browsing and tracking events, and inactive visitor records, are deleted after 90 days of inactivity. Conversations and leads are kept until you delete them or your workspace is deleted. To delete a workspace and its data, an owner emails hello@higherops.io.

6. Installation and availability

You are responsible for installing HigherChat correctly and for Your Site. We may change how the widget looks or works, and HigherChat may be unavailable at times. We are not responsible for lost leads or conversations if HigherChat is unavailable or misconfigured.

7. Changes

We may change these HigherChat Terms under section 16 of the Terms of Service.
